In The Name of God Amen I William TAYLOR of Carbonear Island of Newfoundland, planter being of sound mind & memory do make this my last will & testament & desire it may be received as such.
I give & bequeath to my wife Catherine TAYLOR my dwelling house & furniture, one third of the kitchen garden & the back garden, the land in front of the house to the sea, half of the schooner Lavinia. at her my wife's decease the vessel be sold, the proceeds of such sale to be equally divided between my sons John & Richard, also to my wife Catherine TAYLOR one half of the Brig. Lady Young. The profits arising to that vessel during her life to be distributed to the children of my late son Nathaniel as she may think fit & at her death the said half of the Lady Young to be sold & the net finances to be equally divided between the children of my late son Nathaniel. Also to my wife Catherine TAYLOR what money I may be possessed of & at her death to be divided between my children.
To my son Edward I give the house he now occupies together with two thirds of the kitchen, also the whole of the ------garden in trust for his children who are not to dispossess him or his wife Maria during their lives.
To my son William the house & land now in his possession. To my son John the house he now occupies as well as the land in trust for his children who are not to dispossess him or his wife Mary during their lives, being bound on the east by the sea, on the south by the brook, on the north by his brother William's house & on the west by the back fence. To my sons John, Joseph, & Edward equally that part of my land known by the name Marsh from the water to the back fence, in dividing the same Joseph is to have the southern part.
To my son Richard, the house, garden & land he at present occupies in trust for his children, that is to say William & George are to have the dwelling house & garden, the remainder to be equally divided, to receive no possession during their father's life.
To my son Joseph in trust for his children the house garden now in his occupancy, the children to have as claim during his life. To my late son Nathaniel's children the house & gardens they & their mother possess at express condition present, on this their mother Ann TAYLOR can remain in the house during her life.
To my grandson Augustus TAYLOR my rights, title & interest in & to house gardens --- now in the occupancy of his father Francis TAYLOR situate on the north side of this harbour.
Lastly I wish it to be perfectly understood that the bequeathments aforesaid to my sons do not give them any right to grant, bargain, or sell any part of land or houses from their children.
I constitute & appoint Thomas CHANCEY & Nichols NICHOLE executors to this my last will & testament. Signed & sealed in Carbonear this seventh day of August in the year of our Lord one thousand eight hundred & thirty seven. Signed & sealed in the presence of us, Philip TOCQUE, WW BEMISTER
Codicil
Be it known to all whom it may concern I William TAYLOR testator to the aforesaid will & testament being this day of sound mind & memory have made the following alterations & desire it may be so received. First the brig Lady Young being sold & any proportion of said vessel say one half being in money which together with the half of the schooner Lavinia & whatever money else I may die possessed of I give to my dear wife Catherine TAYLOR during her life to be used as she may think proper & when deceased what may be left to be equally divided between my sons & daughter Julia CHANCEY & further as it has pleased Almighty God to remove Thomas CHANCEY one of my former assigned executors, I hereby constitute & appoint John BEMISTER to act in his -----.
The above signed & sealed in Carbonear this fifth day of November one thousand eight & forty three.
