Names given are Richard, William, Basill & Henry TAYLOR INDENTURE - RichardD TAYLOR with John CLARK/John OSMOND Carbonear - 1795 This indenture made the twenty seventh day of April in the year of our Lord one thousand seven hundred & ninety five & in the 35th year of the Reign of our Sovereign Lord George the Third, King of Great Britain, France & Ireland, Defender of the Faith, etc. Between John CLARK & John OSMOND, both of Crokers Cove in the Island of Newfoundland & Richard TAYLOR of Carbonear in the same Island of Newfoundland. Witnesseth that the said John CLARK & John OSMOND, for & in consideration of the sum of thirty pounds of British money, one half to be paid in hand on or before the Sealing & delivery of these present, & the other half to be paid the following year, hath assigned & set over unto the said Richard TAYLOR & his Heirs, Executors, Administrators & Assigns all that Room or Plantation situated & lying in Carbonear in the Island of Newfoundland, bounded on the west by the said Richard TAYLOR's Room & on the east by Hugh PENNY's Room together with all ways, paths, passages & appurtenances thereto belonging, to have & to hold the said plantation unto himself, his heirs & assigns forever; also all the right, title, Estate, property & claim whatever, both in Law & Equity, & it shall & may be lawful for the said Richard TAYLOR, his Executors, administrators & assigns from time to time, & at all times, to enter, enjoy, possess, have & hold the said Room & Plantation & appurtenances hereby intended to be assigned to his & their use & benefit, to receive & take the Rents & profits thereof without the less hindrance or interruption of the said Jn CLARK & John OSMOND, their Executors & administrators or any person or persons whatever. In witness whereof, we the said John CLARK & Jn OSMOND have hereunto set our hands & seals the day & year above written. Sealed & delivered in the presence of as where no stamps are to be had. AGREEMENT RE: Land Division (Wm, Henry & Richard TAYLOR) Carbonear - March 31, 1809 This is to certify to all whom it may concern that we have this day agreed to divide the plantation belonging to us in Carbonear & on which we now reside, in the following manner, viz. after being measured, in the three equal parts from the fence which separates it from the room or plantation lately belonging to Henry KNIGHT to the limits on the west by a plantation belonging to Mrs Elizabeth PIKE; Henry TAYLOR to have the eastern part, Wm TAYLOR the middle, & Richard TAYLOR the western part, each party having an equal interest in the dwelling house. First, I most humbly bequeath my Soul to God, my Maker, beseeching his most gracious acceptance of it through the all sufficient merits & mediation of my most compassionate Redeemer Jesus Christ who gave himself to be an atonement for my Sins in this hope & confidence I render up my Soul with comfort humbly beseeching the most blessed & Glorious Trinity, One God, most Holy, most merciful & Gracious to prepare me for the time of my dissolution & then to take me to himself into that Peace & Rest which he has prepared for all that love & fear his Holy Name. Amen. Blessed be God, I give my Body to the Earth from whence it was taken in full assurance of its resurrection from thence at the last day. As to my Worldly Estate, I will give & bequeath them as follows. First I give my Dear & loving Wife, Ann TAYLOR, for the Term of her life this House in which I now dwell with all the Furniture & likewise the Lands & Tenements which lie about it with all & every thing appertaining thereto & at her Death to be divided amongst her Children as follows. Item, I give & bequeath to my eldest son, William TAYLOR, a Room which is situated as follows: Eastern part bounded on the East by Mr Henry C WATTS, by the West from the Westward corner of the Store now belonging to him up to the Westward side of the mare's House & from thence up to the bound stone as far as the Public Path, Southerly with this exception that if he should die without issue & his Widow in after time marry any one otherwise named than Taylor by surname, it shall devolve to the surviving Brothers to be equally shar'd North & South by them or who they may appoint. Second, Westerly from the Westward Corner of William TAYLOR, my Son's Store, to the bound Stone further westward & as far back northerly as my bounds goes, the same breadth in back as front (excluding a Cellar & Fish House now there wich shall be the property of my son, Jonathan) I bequeath to my son Richard TAYLOR. Third, westerly from the bound stone of Richard's to the bound stone of Joseph's westward (excluding the spot now in the possession of my son John to say from the back of his House to Waterside & from the path way to the fence parting Joseph's from Jonathan's) the Kitchen Gardens to stand & be kept fenc'd in the same place as they now are, the Dwelling House with all the Furniture, the Cow House & the bounds as far Northward as it extends the same breadth in back as front, I bequeath to my Son, Jonathan, the path way up & down to be kept the same breadth as it now is, the ground to be the property of Jonathan, tho' to be as free to one as the other for the use & benefit of the several sons, viz. Richard, John, Joseph & Jonathan. Fourth, Westerly part from the Path way westward as far as my Son Joseph's fence or bound stone, & from the back of my Son, John's, House to the Waters edge same in front as back, also Fifteen Yards westerly from the Eastward bounds viz. Mr. H. C. Watts from the Street northerly as far as my bounds extends which is to my Son Richards Garden the same in back as front I bequeath to my Son John. Fifth, Westerly from Robert HOWELLs bounds Eastward as far as the bound stone in the little Garden put by me the same breadth in back as front (excepting the Gardens which are to be left as they now are as mentioned before) I give & bequeath to my Son, Joseph. Item, the Eastward part allotted for my Son William in case of his Death without male issue, not liking it should go out of the Family name, I ordain to be separated equally between the surviving Brothers North & South, his Widow being allowed the use & privilege of it as long as she may live, each to have a Regular share of Flake Room from the westward corner of William's Store as far Westward as the extreme bounds to be divided as follows: the Eastward for Richard, next Westerly for Jonathan, next Westerly for John & next Westerly for Joseph. ...Executors, Administrators or Assigns for ever (excepting the case stated in Williams). I do hereby constitute & appoint William HOWELL Jun, son of William of Carbonear, & Samuel RUMSON of Carbonear my true & lawful Executors & doubting not but they will if God spares them, see this my last Will & Testament fully executed according to my desire. In Witness thereof, I have hereunto set my hand & Seal in Carbonear this Twenty third day of August in the year of our Lord One thousand eight hundred & fifteen. Signed & sealed by Richard TAYLOR. I further give & bequeath to my son, John, the full & sole possession of the Pew now my property in the Methodist Chapel in this place whilst he lives & his heirs hereafter. Further to my Daughter, Ann, who is now a Widow, I give & bequeath the Room I now occupy as a bed Room to her to occupy with free toleration to & from, without molestation as long as she Remains in a Widowhood state with all the furniture therein under the same restrictions. Gosse Pack & Fryer, Merchants of Carbonear, the sum of Three hundred thirty six pounds, two shillings & one penny due me as to & furnished since December the Thirty first, One thousand eight hundred & twenty six, & One hundred & fifty pounds in cash now in my possession in form & manner as follows. First, I desire my Executors to take from the above Sums the sum of Thirty six pounds two Shillings & one penny to defray my Funeral expenses or other charges necessary thereunto. Second, to my Son Richard I bequeath the Sum of Seventy Pounds. Thirdly, to my Son John, Ninety Pounds. Fourthly, to my Daughter, Mary NOEL, the sum of Fifty Pounds, Fifthly, to my Daughter, Ann BEST, the sum of Sixty Pounds. Sixthly, to my son, Jonathan, the sum of One hundred Pounds. I give & bequeath to my wife Catherine TAYLOR my dwelling house & furniture, one third of the kitchen garden & the back garden, the land in front of the house to the sea, half of the schooner Lavinia. at her my wife's decease the vessel be sold, the proceeds of such sale to be equally divided between my sons John & Richard, also to my wife Catherine TAYLOR one half of the Brig. Lady Young. The profits arising to that vessel during her life to be distributed to the children of my late son Nathaniel as she may think fit & at her death the said half of the Lady Young to be sold & the net finances to be equally divided between the children of my late son Nathaniel. Also to my wife Catherine TAYLOR what money I may be possessed of & at her death to be divided between my children. To my son Edward I give the house he now occupies together with two thirds of the kitchen, also the whole of the ------garden in trust for his children who are not to dispossess him or his wife Maria during their lives. To my son William the house & land now in his possession. To my son John the house he now occupies as well as the land in trust for his children who are not to dispossess him or his wife Mary during their lives, being bound on the east by the sea, on the south by the brook, on the north by his brother William's house & on the west by the back fence. To my sons John, Joseph, & Edward equally that part of my land known by the name Marsh from the water to the back fence, in dividing the same Joseph is to have the southern part. To my son Richard, the house, garden & land he at present occupies in trust for his children, that is to say William & George are to have the dwelling house & garden, the remainder to be equally divided, to receive no possession during their father's life. To my son Joseph in trust for his children the house garden now in his occupancy, the children to have as claim during his life. To my late son Nathaniel's children the house & gardens they & their mother possess at express condition present, on this their mother Ann TAYLOR can remain in the house during her life. To my grandson Augustus TAYLOR my rights, title & interest in & to house gardens --- now in the occupancy of his father Francis TAYLOR situate on the north side of this harbour. Lastly I wish it to be perfectly understood that the bequeathments aforesaid to my sons do not give them any right to grant, bargain, or sell any part of land or houses from their children. I will devise and bequeath unto my wife Sarah Anne Winton all the property that I am possessed of or entitled to consisting of the interest of the house in which I now reside my household furniture, bed, bedding and linen, plate & plated ware books and pictures, my watch and chain and other personal effects I also bequeath to my said wife any balance of wages due me from my employees Messrs. P. & L. In those days, the name Amy was often interchangeable with Emma, and we know there was a daughter Emma. However, we are told that there was an unmarried sister who lived with unmarried brother Esau, so perhaps Amy did exist (as distinct from Emma). Her birthdate is unknown, but she could possibly the female living with William in 1836 who was under 14 years. A birthdate of Aug 1846 (source unknown) is highly suspect.
